First Choice Women’s Resource Centers, Inc. v. Davenport sent back to District Court
State Treasurer Larry Pack today applauded the unanimous decision by the United States Supreme Court that stated New Jersey faith-based pregnancy centers have the right to challenge a state subpoena demanding donor records. The court argued that prevention of such a challenge violates the center’s first amendment right. The case was sent back to the district court for further proceedings.
“This is clear violation of the first amendment and an attempt to intimidate those who support pregnancy centers around the country. Pregnancy centers are doing vital work connecting mothers and their babies to resources they desperately need. Any attempt to undermine this work is just plain wrong,” Treasurer Pack said. “Under Governor Jim Justice, we were able to put state dollars to support our pregnancy networks in West Virginia. I will continue to fight for support for these great organizations.”
The subpoena demanded 28 categories of documents, including names, contact details, and employment information for donors contributing through channels other than a specific webpage—effectively covering nearly 5,000 donations over up to 10 years, according to Alliance Defending Freedom. It warned of contempt and penalties for noncompliance.
Treasurer Pack was instrumental in securing state funding for pregnancy centers when he worked for Governor Justice who launched the West Virginia Mothers and Babies Support Program. The program helps raise the adoption tax credit and supplies pregnancy centers with necessary funding to be used for free pregnancy tests, ultrasounds, medical exams, counseling and resources such as food, diapers and clothing. Treasurer Pack advocated for continued state funding during the 2026 Regular Legislative Session.
In March, Treasurer Pack helped the Women’s Care Center in Parkersburg welcome a new mobile unit to serve the needs of the surrounding rural communities with pregnancy testing, limited obstetrical ultrasound services, pregnancy options education, and special STD clinic days.
